Who ensures the listings are legal? With much home title frauds happening Ontario and all over Canada, surely there is some form of goverence. Is there a duty to report the illegal sale of a property? Or suspicion of an illegal sale? Such as the homeowners information. Are just any listing accepted if it comes from a broker? Is it assumed that the broker has all the proper documentation, to sale a property? A case of a homeowner being defrauded out of his home and property, by a alleged private lender. It was only discovered after the property sold, that the alleged lender was the broker who demanded a quick sale, in a matter of days it was sold, listed at 149 9k sold three days after a bid of 160k. This transaction should have sent off red flags all over the place. Is MLS becoming a market for criminals to pawn their ill begotten gains?

Hi Mindy, Thanks for leaving a comment, certainly lots here to discuss, I'll leave you some of my opinions. While I can not comment on a transaction you might describe without knowing the details, I would tell you that the MLS is not a haven for illegal activity. It is common to see a vendor take back a property which has been foreclosed on through legal process. Listings are legal from the standpoint that it is the owner/seller who engages in a contract to list the property for sale with an agent/brokerage. There are several steps an agent will take to verify the property information, some are required, some might be considered best practice and might vary from identification of the seller, property history, legal inquires for anything questionable on title, available tax information, title information/verification and a process for seeking details of the home and the seller. Each agent/brokerage would likely have a process for this, I know in my business, I certainly have SOP's for each listing to ensure all these details and information is vetted. There are safeguards in place to ensure an agent knows whom they are transacting with and requirements through FINTRAC for reporting of anything suspicious, an agent/brokerage could also choose not to work with a seller in the instance where the details can not be verified.
