Understanding the Agency Relationship in Real Estate

 
 
 
Real estate transactions can often be quite complex, and learning about Agency is an important part of the process when buying or selling property, as it provides a reliable framework for conducting transactions.
 
Under Agency, the agent owes a fiduciary duty to you, the client, to follow your lawful instruction. This includes keeping client's information confidential, and providing exclusive representation, while exercising care, skill and diligence.
 
In Saskatchewan as it relates to Real Estate, there are 3 forms of Agency:
 
Buyer's Agency - represents the interests of the buyer.
 
Seller's Agency - represents the interests of the seller.
 
Limited Dual Agency - represents the interests of both the buyer and seller. (more on this later)
